Welcome to Christopher Yates Fine Portraits. These Terms of Service govern your use of our website and the photography services provided by Christopher Yates Fine Portraits, including services marketed as Christopher Yates Professional Headshots.
By using this website, scheduling a photography session, or purchasing products or services from us, you agree to the following terms.
1. Photography Services
Christopher Yates Fine Portraits provides professional photography services, including professional headshots, personal branding photography, business portraits, and related photographic services.
Specific services, session lengths, number of images, pricing, and other details are described at the time of booking or in a separate written proposal or agreement.
2. Scheduling and Booking
Photography sessions are subject to availability.
Your session date and time are reserved specifically for you. Please arrive on time and prepared for your session. Arriving late may reduce the amount of photography time available and may not extend the scheduled ending time of your session.
3. Payment
Pricing and payment requirements are provided at the time of booking.
Unless otherwise stated, all fees are quoted in U.S. dollars. Applicable taxes may be added where required by law.
Any additional images, retouching, products, or services requested beyond those included in the selected photography experience may result in additional charges.
4. Cancellations and Rescheduling
We understand that schedules sometimes change.
If you need to cancel or reschedule your session, please contact us as soon as possible. Rescheduling is subject to studio availability.
Christopher Yates Fine Portraits reserves the right to establish specific cancellation, rescheduling, deposit, or no-show policies for individual photography services or promotions. When applicable, these policies will be disclosed during the booking process and will become part of your agreement with us.
If Christopher Yates Fine Portraits must reschedule a session because of illness, emergency, equipment failure, weather, or circumstances beyond our reasonable control, we will make reasonable efforts to arrange a new session date.
5. Image Selection and Retouching
The photographer retains creative discretion regarding lighting, posing, composition, image selection, editing, retouching, and the overall photographic style.
Not every photograph created during a session will be delivered. Christopher Yates Fine Portraits will determine which photographs meet our professional standards and are suitable for presentation.
Unless specifically included in the purchased service, RAW files, unedited photographs, test images, duplicate images, and rejected images are not provided.
Final photographs may include professional adjustments and retouching consistent with the style and standards of Christopher Yates Fine Portraits.
6. Copyright and Your Use of Photographs
Unless otherwise agreed to in writing, all photographs created by Christopher Yates Fine Portraits are protected by United States copyright law, and the copyright remains with Christopher Yates Fine Portraits and/or Christopher Yates.
When you purchase or receive digital photographs, you are granted permission to use the delivered photographs for the purposes associated with your photography session.
For professional headshot and personal branding clients, this generally includes use on websites, LinkedIn and other social media profiles, company directories, marketing materials, business cards, press releases, speaking engagements, publications, and other reasonable personal or professional promotional uses.
You may not sell, license, substantially alter, or transfer ownership of the photographs to another party without written permission, except as reasonably necessary for your employer, marketing agency, designer, publisher, printer, or similar service provider to use the photographs on your behalf.
7. Photographer's Use of Images
Christopher Yates Fine Portraits may request permission to display photographs created during a session for portfolio, website, social media, advertising, competition, educational, or promotional purposes.
When separate permission or a model release is required, such use will be governed by that authorization.
8. Turnaround and Delivery
Estimated delivery times may be provided at the time of your session or purchase. Delivery times are estimates and may vary depending on the number of images, retouching requirements, workload, and other circumstances.
Clients are responsible for downloading and safely storing delivered digital photographs.
Christopher Yates Fine Portraits does not guarantee indefinite storage or archival of client photographs after final delivery.
9. Client Responsibility
Clients are responsible for providing accurate contact, scheduling, and payment information.
Clients are also responsible for their personal appearance, wardrobe, hair, makeup, grooming, and other preparation unless those services are specifically included in the photography experience.
While we provide professional guidance regarding posing, expression, wardrobe, and presentation, individual preferences regarding personal appearance are subjective.
10. Satisfaction Guarantee
Certain photography experiences may include a specific satisfaction guarantee.
Any guarantee applies according to the terms presented with that particular offer or photography experience. Promotional offers, special events, group photography, corporate assignments, or other services may have different terms or may not include the same guarantee.
11. Website Content
The photographs, text, graphics, logos, designs, videos, and other materials appearing on this website are owned by or licensed to Christopher Yates Fine Portraits and are protected by applicable intellectual property laws.
You may not copy, reproduce, republish, distribute, or commercially use website content without prior written permission.
12. Third-Party Services and Links
Our website may contain links to or integrations with third-party services, including scheduling systems, payment processors, social media platforms, and other websites.
Christopher Yates Fine Portraits is not responsible for the content, availability, security, privacy practices, or policies of third-party websites or services.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Christopher Yates Fine Portraits and Christopher Yates will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of this website or our photography services.
